Procurement Requirements
When procuring construction contracts it is important to place demands on the materials used for the projects. This needs to be done to ensure that the contractor primarely uses products assessed with regards to the content of substances of high concern.
The requirements can be formulated as follows:
- Built-in products shall fulfill the BASTA criteria (alternatively the BASTA and BETA criteria) to the extent specified.
- This is substantiated and confirmed by the products BASTA registration (alternatively registered in the BASTA and BETA register) or documented in some other reliable way.
- Deviations from these requirements shall be reported as non-conformities.
Public Procurement
In the public sector procurers increasingly refer to environmental Assessment (EA) criteria when making purchasing decisions. EU procurement directive regulations permit references to specific criteria in technical specifications. However, it is not permissible to require that any one particular strategic environmental assessment system (SEAS) is used to show that the criteria are met.
It is also important to remember that BASTA, with a few exceptions, is approved as an authentication service even when requirements have been made that refer to criteria set by competing environmental assessment systems. If you are a contractor in a project where reference is made to BASTA criteria the use of BASTA management tools is ample verification that these criteria have been fulfilled. Therefore you as entrepreneur will always be able to utilize BASTA to verify your choice of safe materials, concerning hazardous substances, for public procurement construction contracts.
The National Agency for Public Procurement helps public bodies implement environmental and social demands in their procurement practices. Among other things they provide procurement criteria that can be used when purchasing goods and services. In the procurement criteria for construction contracts they refer to the BASTA criteria for materials selection.
